Terms and Conditions – Winch Repairs

Welcome to Winch Repairs. These Terms and Conditions (“Terms”) govern your use of the computer repair services and PC building services provided by Winch Repairs (“we”, “us”, or “our”) through our website at [Your Website URL] and in person.

1. Definitions

  • “Client,” “You,” “Your” refers to the individual or entity engaging our services.
  • “Services” refers to all computer repair, maintenance, diagnostic, and PC building services offered by Winch Repairs.
  • “Equipment” refers to any computer hardware, software, peripherals, or components provided by the Client for our Services.
  • “New Build” refers to a custom-built personal computer assembled by Winch Repairs according to Client specifications.

2. Service Agreement

These Terms constitute a service agreement between Winch Repairs and the Client. By accepting our services, you acknowledge and agree to these Terms.

3. Computer Repair Services

3.1. Diagnostic Services

  • We will perform diagnostic services to determine the cause of issues with your Equipment.
  • A diagnostic fee of [Specify Diagnostic Fee, e.g., £50] may apply if you do not proceed with the recommended repair, or as otherwise stated. This fee covers the time and expertise required to assess your equipment.

3.2. Repair Process

  • We will provide an estimated cost and timeframe for repairs. This is an estimate only and may change based on unforeseen issues or parts availability. We will inform you of any significant changes.
  • We reserve the right to refuse any repair service if we deem the Equipment beyond economical repair, if parts are unavailable, or for any other reason at our sole discretion.
  • All repairs will be performed using commercially reasonable efforts and in a professional manner.

3.3. Parts and Components

  • We may use new, refurbished, or compatible parts for repairs, at our discretion, unless otherwise specified and agreed upon in writing.
  • Ownership of any replaced parts may revert to Winch Repairs unless explicitly stated otherwise.

3.4. Data Backup and Loss

  • It is the sole responsibility of the Client to back up all data, software, information, and programs on their Equipment prior to submitting it for service.
  • Winch Repairs will not be held responsible for any loss, corruption, or recovery of data, programs, or information during the course of providing Services, even if a data backup service is purchased separately.
  • While we may offer data backup as a separate service, we do not guarantee its success or completeness, and it does not absolve the Client of their primary responsibility.

3.5. Repair Warranty

  • We offer a warranty on our repair services for a period of [Warranty Period for Repairs, e.g., 90 days] from the date of collection/delivery of the repaired Equipment.
  • This warranty covers the specific repair performed and parts replaced. It does not cover new issues, issues caused by user error, accidents, viruses, software conflicts, or unrelated hardware failures.
  • Any attempt by the Client or a third party to repair or modify the Equipment after our service will void this warranty.

4. PC Builder Services (New Builds)

4.1. Consultation and Specification

  • We will consult with you to determine the specifications and components for your custom PC build.
  • Final specifications and component choices will be confirmed in writing (e.g., via email or a formal quote) before the build commences.

4.2. Pricing and Payment (New Builds)

  • A detailed quote for the New Build, including all parts, labour, and estimated shipping (if applicable), will be provided.
  • A deposit of [Specify Deposit Percentage, e.g., 50%] of the total quote may be required before component ordering. Full payment is due upon completion and prior to handover/shipping.
  • Prices are subject to change due to market fluctuations in component costs. We will inform you of any significant price changes before proceeding.

4.3. Build Process and Timeframes

  • We will provide an estimated timeframe for the completion of the New Build. This is an estimate only and is subject to component availability and unforeseen build complexities.
  • Winch Repairs is not responsible for delays caused by component suppliers or shipping issues.

4.4. New Build Warranty

  • New Builds come with a warranty covering parts and labour for a period of [Warranty Period for New Builds, e.g., 1 year] from the date of collection/delivery.
  • Individual components may carry separate manufacturer warranties, which the Client will be informed of.
  • This warranty does not cover damage caused by misuse, accidents, unauthorized modifications, improper software installation, viruses, or normal wear and tear.
  • Opening the PC case or tampering with internal components by the Client or a third party may void the labour warranty provided by Winch Repairs.

5. Payment Terms

  • Payment for all Services is due upon completion and prior to the return of Equipment or New Build, unless otherwise agreed in writing.

  • Unpaid invoices may be subject to late fees of [Specify Late Fee/Interest, e.g., 5%] per month or part thereof.

6. Client Responsibilities

  • Promptly collect Equipment or New Builds upon completion and notification.

7. Limitation of Liability

  • In no event shall Winch Repairs be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
  • Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you for the specific Service in question.

8. Intellectual Property (Software)

  • Winch Repairs will not install or provide any unlicensed software.
  • The Client is responsible for providing valid licenses for any operating systems or software they wish to have installed.
  • We are not responsible for software licensing compliance.
  • For custom builds, any software installed will adhere to [Software License Terms, e.g., manufacturer’s EULA or open-source licenses].

9. Governing Law and Jurisdiction
